These Terms of Service set out the rules that apply when you use the website at bgdfood.buzz or buy a service from the market crate stand operated by Bgd Food Market Inc. at 1410 Victoria Park Ave, North York - M4A 2L8, Canada (CA). By loading a page, sending a message, or placing an order, you agree to these terms. If you do not agree, please do not use the website or book a counter service.
We have written the terms in plain English so the counter staff and the customer can both read them without legal training. Where a separate written agreement has been signed for a large catering job, that agreement will apply to the extent it differs from these terms. The website is maintained by the developer BGD Food on behalf of the company.
1. The agreement
These terms form a binding agreement between you and Bgd Food Market Inc. They apply to the website, to the contact form, and to every counter service described on the site. They also apply to the paper records used at the counter, including order sheets, quote sheets and pantry cards, because those records are part of the same service.
These terms replace any earlier terms published on the website. They do not replace a signed catering agreement where one exists. If a provision of these terms is found to be invalid, the rest of the terms will continue to apply.
2. Definitions
In these terms, the words below have the following meanings.
- The company means Bgd Food Market Inc., the operator of the market crate stand.
- The counter means the staffed grocery counter inside the market hall at the address above.
- The website means the pages published at bgdfood.buzz and any subdomain operated by the company.
- A service means a weekly special bay purchase, a bulk order run, a deli platter, a fresh cut window item, a pantry staples review, or a catering quote sitting.
- An order means a request to buy goods or book a service that the counter has confirmed.
- Business day means Monday to Friday, excluding public holidays in Ontario, Canada.
3. Eligibility and account free use
You may use the website if you are able to form a binding contract under the law that applies to you. You do not need an account to browse the site or to send a message. If you are booking on behalf of a business, a family or an event, you confirm that you have authority to place the order and to agree to these terms for that group.
The website does not create an account, does not store payment card data, and does not allow any person to log in. All communication runs through email, telephone, or the counter itself.
4. The services we offer
The company runs six counter services. Each is described in more detail on the services page, and the summary below sets out the general expectation.
Weekly special bays
Seasonal produce sold by weight from marked crates during hall hours. Availability changes through the week and a price may move when a supplier moves.
Bulk order runs
Boxed produce and staples prepared for collection after booking at least one working day ahead. Boxes are counted twice before release.
Deli platter desks
Trays built to a written sheet behind a cold slab, tagged with the build date and wrapped level for transport.
Fresh cut windows
Prepared produce cut and weighed during posted hours when the board is clean and the blade is newly set.
Pantry staples reviews
A short planning session at the counter that produces a written note about what a household uses and what it should stop buying.
Catering quote sittings
A booked discussion at the tall table that results in a written quote held for one week.
The company may add, change or withdraw a service where stock, season or staffing requires it. A withdrawal will not affect an order already confirmed, unless the produce itself is unavailable, in which case the cancellation section applies.
5. Placing an order
A message sent through the contact form, or an email or telephone call, is a request and not a confirmed order. An order is confirmed only when the counter replies with a written confirmation that names the items, the weight or quantity, the collection date and the total price. If you do not receive that confirmation, the order has not been accepted.
The counter may refuse a request where stock is short, where the requested date cannot be met, where the order is outside the normal scope of the counter, or where the request appears to be fraudulent. If a request is refused, the counter will explain why and, where possible, suggest a different date or a smaller order that can be filled.
Please check the confirmation carefully. If a line, a weight or a date is wrong, tell the counter before the collection time so that the change can be made while the crate is still in the hall.
6. Pricing and weights
Prices are shown in Canadian dollars. Produce is sold by weight, and the final charge is based on the weight recorded on the counter dial at the time the bag is sealed. The weight written on the bag is the weight that is used for the price, and a customer may ask to see the dial for any item.
A quoted price for a platter, a cut item or a catering job is held for one week from the date of the quote unless the quote says otherwise. Beyond that period the counter may issue a new quote if the cost of the produce has moved. Hand written crate flags are reviewed each morning, and a flag that has been superseded is replaced rather than left to confuse a buyer.
Taxes are added where the law requires them and are shown on the written confirmation. The company does not charge a service fee for a standard counter purchase and no hidden charge is added at collection.
7. Payment
Payment is taken at the counter when the goods are collected, or by another method agreed in writing for a larger catering job. The website does not process payments and does not store card details. The counter will tell you which methods are accepted on the day.
If a deposit is agreed for a large event, the confirmation will state the amount and the date it is due. A deposit is applied to the final total. Where a cancellation rule applies to the deposit, the rule will be written in the confirmation so there is no doubt about what happens if the event changes.
8. Collection and delivery
Unless a delivery is agreed in writing, all goods are collected from the counter at 1410 Victoria Park Ave, North York - M4A 2L8, Canada (CA). The counter will keep a confirmed order for the collection time stated in the confirmation. If you are running late, call +14097466998 and the counter will hold the order where space and produce condition allow.
The company does not currently operate a delivery fleet. If a third party carrier is used at your request, the carrier acts for you and the company is not responsible for a delay or a handling fault that happens after the goods leave the counter. Fresh produce should be kept cool on the way home, and the counter will bag accordingly.
9. Cancellation and changes
A weekly special bay purchase may be cancelled before the bag is sealed, and the counter will return the item to the crate without charge. A bulk order run may be cancelled up to the end of the working day before collection without charge. A cancellation after that point may carry a charge for produce already packed, and the confirmation will state the amount.
A deli platter or a catering job may be changed up to two working days before the event date where the produce can still be adjusted. A change after that point depends on what has already been built, and the counter will tell you honestly whether a change is possible. If the counter cannot fill an order because of a stock failure, the order will be cancelled and any amount paid will be returned in full.
10. Produce quality and freshness
The company buys produce for condition rather than for appearance alone, and the crates are checked each morning. Even so, fresh food is a natural product and a piece can turn after it leaves the hall. The counter asks that you inspect the bag at collection so that a problem can be spotted before you leave.
Where a crate is running light or a line is short, the counter will say so before packing. The company would rather sell a smaller bag with an honest note than fill a bag with produce that will not last.
11. Returns and refunds
If a produce item is not fit for the purpose it was bought for, bring it back to the counter with the bag and the confirmation, and the counter will replace it or refund the price. A return should be made within a reasonable time and normally within two days of collection, because fresh food cannot be resold after a long delay.
A deli platter or a prepared item that has been handled incorrectly after collection cannot be refunded for a quality issue that arose after it left the cold slab. The counter will still look at the matter fairly and will explain the reason for a decision in plain words.
Refunds are made by the same method used for payment. Where a refund is not possible on the day, the counter will give a written note showing the amount and the date the refund will be issued.
12. Allergens and dietary notes
The deli platter desk and the fresh cut windows handle a range of ingredients, and a shared surface means that a trace of an allergen can be present even when the ingredient is not part of the recipe. If you have an allergy, tell the counter when you order so that the platter can be built with care and so that the staff can advise on what can be prepared safely.
Dietary notes that you volunteer are kept only for the order in hand and are not added to a profile. The company cannot guarantee a completely allergen free environment, and a customer with a severe allergy should rely on their own medical advice when deciding what to buy.
13. Permitted use of the website
You may use the website for lawful personal or business purposes connected to the counter. You must not attempt to gain unauthorised access to the server, interfere with the operation of a page, upload a harmful file, scrape the site in a way that degrades service, or use the contact form to send spam, threats or unlawful material.
The company may suspend access to the website for maintenance or for a security reason. Where a suspension is planned, the company will try to give notice, but an urgent suspension may happen without notice to protect the site and its visitors.
14. Intellectual property
The text, layout, code and visual design of this website belong to the company or are used with permission. The name Bgd Food Market Inc. and the shopfront sign are protected marks of the company. You may read, print and share a page for personal reference, but you may not copy the site in a way that suggests it is your own, resell the content, or use the marks in a way that confuses a customer about who runs the counter.
A short quotation of text with a clear credit and a link back to this site is welcome. A commercial reproduction needs written permission from the company, which may be requested through update@bgdfood.buzz.
15. Messages and user content
When you send a message, you confirm that the information in it is accurate and that you have the right to share it. You grant the company permission to use the message for the purpose of answering you and preparing an order. The company will not publish your message or your name on the website without your agreement.
The company may keep a copy of a message where it is needed for an order record or for a legal purpose. Retention periods are described in the Privacy Policy, which forms part of these terms.
16. Limitation of liability
The website is provided as it is. The company works to keep the site accurate and available, but it does not promise that every page will always load without error or that every price shown on a page will match the flag on a crate on the day. Where a price differs, the counter flag and the written confirmation are the figures that apply.
To the extent permitted by law, the company is not liable for an indirect loss, a lost profit, a lost opportunity or a loss arising from a third party carrier. Where a loss is caused by the company and the law does not allow the loss to be excluded, the liability of the company is limited to the amount paid for the order that gave rise to the loss.
Nothing in these terms limits a right that a consumer has under the law of Ontario or Canada where that right cannot be excluded by agreement.
17. Indemnity
You agree to compensate the company for a loss, a cost or a reasonable legal fee that arises from your misuse of the website, from a message you send that is unlawful or defamatory, or from your breach of these terms. This obligation does not apply where the loss is caused by the company itself.
18. Events outside our control
The company is not responsible for a delay or a failure caused by an event outside its reasonable control. Examples include a severe storm, a flood, a power failure, a road closure, a public health order, a supplier failure or an industrial dispute. Where such an event affects an order, the company will contact you as soon as it can and will offer a new date or a full refund for the part of the order that cannot be filled.
19. Privacy
The Privacy Policy published at /privacy explains how personal information is collected, used and protected. It is part of these terms. By using the website or ordering from the counter, you agree that personal information may be handled as described in that policy.
20. Governing law and disputes
These terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there. If a dispute arises, the parties will first try to resolve it by a written exchange and, where useful, a short conversation at the counter. If that does not settle the matter, the courts of Ontario will have jurisdiction, unless a consumer protection law gives you the right to bring a claim in another forum.
Before starting a legal step, please write to update@bgdfood.buzz with a short description of the problem and the outcome you are looking for. Most matters are settled quickly when the facts are put in writing.
21. Changes to these terms
The company may update these terms when a service changes or when the law requires it. The date at the top of the page shows the current version. A material change will apply to a new order from the date it is published and will not change the terms of an order already confirmed unless the law requires otherwise.
A paper copy of the current terms can be requested at the counter, and the online version is always the version that applies.
